if you do not agree, please do not use the app. you may delete it at any time and request a refund within the withdrawal period.
these terms constitute a binding agreement between you and nudge under EU law, including Directive 2011/83/EU on consumer rights as amended through 2025.
nudge is a wellness companion app that:
nudge is not a medical device. it does not diagnose, treat, cure, or prevent any disease or health condition. always consult a healthcare professional for medical advice.
nudge is available for a one-time purchase of €4.99 (or local equivalent).
this includes:
payment is processed securely through Apple's App Store. we do not receive or store your payment information.
prices include VAT where applicable under EU Directive 2006/112/EC.
under EU consumer protection law, you have the right to withdraw from this purchase within 14 days without giving any reason.
to exercise this right, contact Apple through the App Store for a refund. the withdrawal period expires 14 days after the day you purchased the app.
if you have begun using the app, you acknowledge that this may affect your withdrawal right as provided under Article 16(m) of Directive 2011/83/EU.
to request a refund:
we grant you a personal, non-exclusive, non-transferable, revocable license to use nudge on your personal devices.
this license permits:
this license does not include ownership of the software or any intellectual property rights.
you agree not to:
violation may result in termination of your license.
nudge is provided "as is" without warranties of any kind, except as required by mandatory EU consumer protection laws.
we do not warrant that:
this does not affect your statutory rights as a consumer under EU law.
to the maximum extent permitted by law, our liability is limited to the amount you paid for the app.
we are not liable for:
nothing in these terms excludes liability for death, personal injury, fraud, or other matters that cannot be excluded under applicable law.
you may stop using nudge at any time by deleting the app.
we may terminate your license if you violate these terms. upon termination, you must delete all copies of the app.
termination does not affect any rights or remedies that have accrued prior to termination.
these terms are governed by the laws of the European Union and the Federal Republic of Germany.
for EU consumers, you benefit from mandatory consumer protection provisions in your country of residence. nothing in these terms affects those rights.
disputes shall be resolved in the courts of your place of residence, as provided under EU Regulation 1215/2012.
you may also use the EU Online Dispute Resolution platform: ec.europa.eu/odr
we may update these terms from time to time. when we make material changes, we will notify you through the app at least 30 days before they take effect.
if you disagree with the new terms, you may stop using the app and request a pro-rated refund for the portion of service not yet received.
your continued use after the effective date constitutes acceptance of the new terms.
